Bilaspur. The High Court has stayed the investigation and FIR lodged against former CM Dr Raman Singh and BJP's National Spokesperson Sambit Patra in the tool kit case. Justice Narendra Kumar Vyas, in his order, has said that the continuation of the FIR and the investigation on the tool kit case will be an abuse of the legal process.
Former CM Dr Raman Singh and BJP's national spokesperson Sambit Patra had filed separate petitions in the High Court to stay the FIR lodged against them. Terming the FIR as biased and politically motivated, it (the petition) said that the petitioners, being BJP leaders, had commented on the digital record available in the public domain. Hence no indictment can be made out against them. Advocate Sharma had said during the plea that the constitution grants freedom to express views, so the FIR lodged, and the deliberation on it must stop.
After hearing the matter on June 11, the High Court had issued a notice on the original petition and called for a reply from the state government. It had reserved the decision on the matter of FIR registered and its investigation. A Single Bench of Justice Narendra Kumar Vyas, in his judgment, has completely stayed the FIR lodged against the petitioners. The bench observed that the continuance of the FIR and the investigation would be an abuse of the legal process.
