Bilaspur High Court quashes the FIR against the State Revenue Minister.

Korba. The Bilaspur High Court has ordered the cancellation of FIR lodged against the State Revenue Minister Jaisingh Agrawal. A case was registered in the Ajak police station of Korba in 2017 against Minister Jai Singh and Councilor Surendra Jaiswal.

An FIR was filed under the SC / ST Act against Chhattisgarh Revenue Minister Jaisingh Agarwal on the order of Special Court, but no complaint was lodged. The Bilaspur High Court has ordered the FIR quashed. Minister Jai Singh and other petitioners are now relieved.

Dukhlal Kanwar, a resident of village Chuiya, Korba had complained in the court. After which, the court case was registered against the ministers Jaisingh Agrawal and Surendra Jaiswal under SC / ST Act 1989 at Ajak police station of Korba. Against which the petition filed in the High Court stated that the complainant had applied directly to the Special Judge's Court under 156 (3) CRPC. Counsel for the petitioners said that the order is voidable without complying with Part 1 and 3 of Section 154 Criminal Procedure Code as being contrary to law. The complainant was supposed to apply to the magistrate in 156 (3) but did not. The Special Court does not have the right to hear the case. The court should repeal the order of the FIR and the Special Court.
